        I would say that it is a bootleg, likely the sample was not licensed so the release couldn't be made officially

        IMO a bootleg is not authorized by the recording artist—the primary one.
      • The recording can be official and have unlicensed or unauthorized samples; that just sets the official issuer up for a lawsuit. A bootleg release of unlicensed samples would (IANAL) actually protect the artist, I would think, since they aren’t responsible for distributing the samples without permission.

        notsosmart: if I make a recording that samples The Beatles, without permission from the rights holder, and I release it officially on my Bandcamp page, I maintain that that is an official release from me, despite the unlicensed samples. I may get sued, but the lack of rights to *their* music doesn’t make *my* music release a bootleg.

        yes, but whomever released this record, didn't think it was worth the risk to release it, plus obviously there is certain "coolness" to releasing a bootleg-like record, but this is yet another reason to treat this release as a bootleg -- the artist intended it to be a bootleg, so why took it away from them :)
